TERMS OF SERVICE

These Terms of Service (“Terms”) govern access to and use of the Elah.io platform (the “Service”), operated by Hypnosis Near Me LLC (“Elah”, “Company”, “we”, “our”, or “us”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

1. Nature of the Service

Elah is a specialized transformation intelligence system designed for practitioners working in subconscious, behavioral, and transformational modalities.

Elah provides tools including, but not limited to:

  • AI-assisted intake
  • Structured session insights
  • Script generation and editing
  • Progress tracking systems
  • Ongoing intelligence reporting
  • Case management tools

Elah is not a CRM system, and is not intended for storing personally identifiable client information.

2. Practitioner Responsibility

The Service is designed for use by practitioners. You are solely responsible for:

  • Your professional conduct
  • Your interactions with your clients
  • The interpretation and application of any outputs generated by the platform

Elah provides guidance, structure, and assistance only.

Final decisions, interpretations, and usage remain entirely under practitioner control.

3. Client Data & Privacy Responsibility

Elah is designed to minimize data exposure.

Practitioners agree to use first names only or initials when referencing clients

Avoid entering any personally identifiable information (PII), including:

  • full names
  • email addresses
  • phone numbers
  • physical addresses
  • medical records

You are solely responsible for protecting your clients’ privacy.

Elah does not verify or monitor compliance with this requirement.

4. Data Handling & AI Usage

Elah enforces the following principles:

  • AI session data is not used to train external AI models
  • Data is not shared across practitioners or tenants
  • No financial data is stored within the platform
  • AI intake sessions are not stored as audio recordings
  • Only structured and necessary data is retained for system functionality

Data Deletion

You may request full deletion of your data at any time by written request.

Upon deletion:

  • All associated records will be permanently removed
  • Recovery is not possible
5. Permitted Use

Elah is intended for:

  • Vocational and avocational development
  • Personal growth, performance, and behavioral change

Prohibited Use

You may not use the Service for:

  • Medical diagnosis
  • Psychological diagnosis
  • Clinical treatment or therapy
  • Emergency or crisis intervention

Elah does not provide medical, psychiatric, or psychological advice.

OPEN CASE PROGRAM

By participating in the Open Case Program, you acknowledge and agree to the following:

      1. Any contribution made through the Elah Intake Project is a contribution to support the operation and development of the platform and is not payment for professional services.
      2. Submission of an intake does not guarantee that a practitioner will accept your case.
      3. Practitioners participating in the Open Case Program are independent professionals and are not employees, contractors, or agents of Elah.
      4. If a practitioner accepts your case, all fees, services, scheduling, and professional arrangements are made directly between you and the practitioner.
      5. Participating practitioners charge a minimum of $150 USD for an initial session. Actual fees may vary and are determined solely by the practitioner.
      6. By submitting an intake, you consent to the creation of an anonymized case summary that may be reviewed by participating practitioners for the purpose of determining whether they wish to accept your case.
      7. Your personal contact information will remain hidden until a practitioner formally accepts your case.
      8. Upon acceptance of your case, your contact information may be shared with the accepting practitioner so they may contact you directly.

6. No Professional Liability

Elah does not:

  • Diagnose mental or medical conditions
  • Provide licensed therapeutic services
  • Replace professional judgment

All outputs are:

– assistive, informational, and supportive in nature

The practitioner is solely responsible for how the platform is used.

7. Limitation of Liability

To the maximum extent permitted by law:

Elah shall not be liable for:

  • misuse of the platform
  • practitioner decisions or actions
  • client outcomes
  • indirect, incidental, or consequential damages
  • The platform is provided as a workflow support system, not an outcome-determining system

Maximum Liability

Our total liability shall not exceed:

> The amount paid by you in the preceding 3 months
> or
> $100 USD

(whichever is greater)

8. No Outcome Guarantees

Elah makes no guarantees regarding:

  • client progress
  • behavioral change
  • transformation outcomes

Results depend on:

  • practitioner application
  • client engagement
  • external factors beyond our control
9. Subscriptions & Billing
  • Access to Elah requires a paid subscription
  • Pricing may change for new users
Founding Access

Early users may retain their pricing indefinitely.

Cancellation
  • You may cancel at any time
  • No refunds are provided for partial billing periods
10. Intellectual Property

All platform content, systems, and technology are owned by Hypnosis Near Me LLC.

You are granted a limited, non-transferable license to use the platform.

You may not:

  • copy
  • resell
  • reverse engineer
  • distribute platform components
11. Acceptable Use

You agree not to:

  • misuse or exploit the platform
  • input prohibited or sensitive data
  • attempt to bypass security
  • use the platform for unlawful purposes
12. Termination

We may suspend or terminate access if:

  • Terms are violated
  • misuse is detected

Upon termination:

  • access is revoked immediately
13. Service Disclaimer

The Service is provided:

We do not guarantee:

  • uninterrupted access
  • error-free operation
  • system availability at all time
14. Future-Proof Protection Clause

You acknowledge that:

  • Elah is an evolving system
  • features and capabilities may change over time

You agree that:

– The Company shall not be liable for regulatory, legal, or compliance changes affecting the use of the platform.

15. Governing Law

These Terms are governed by the laws of the State of California.

All disputes shall be resolved in:
Los Angeles County, California.
